Telemarketing Registration

In India, telemarketers and businesses engaged in telemarketing activities are required to comply with the regulations specified by the Telecom Regulatory Authority of India (TRAI). Telemarketing registration is mandatory for entities involved in making unsolicited commercial communications to consumers through voice calls or SMS.

The process of telemarketing registration in India involves the following steps:

  1. Entity Type: Businesses or entities that wish to conduct telemarketing activities must first determine whether they fall under the category of a "Telemarketer" or a "Principal Entity."

  2. Telemarketer Registration: Telemarketers are entities that make unsolicited commercial communications on behalf of other businesses or clients. They are required to register with TRAI through the telemarketer registration process.

  3. Principal Entity Registration: Principal Entities are businesses or organizations that engage in telemarketing to promote their products or services. They need to register as a Principal Entity with TRAI.

  4. Agreement with Telecom Service Providers: After registration, telemarketers and principal entities are required to enter into agreements with telecom service providers to obtain telecom resources for sending commercial communications.

  5. DND Scrubbing: Before sending any commercial communication, telemarketers must ensure that their calling or messaging list is scrubbed against the National Customer Preference Register (NCPR) or the "Do Not Call" (DNC) registry. The DNC registry is a list of phone numbers of individuals who have opted not to receive commercial communications.

  6. Template Registration: Telemarketers are required to get their message templates pre-registered with TRAI. Only registered templates can be used for sending SMS or voice calls.

  7. Compliance: Telemarketers and principal entities must comply with the regulations, including the restriction on the timings for making calls (9 AM to 9 PM), adherence to DNC regulations, and providing necessary details in the communication.

It is essential for businesses engaged in telemarketing to obtain the necessary registration and follow the guidelines set by TRAI to ensure that their telemarketing activities are legal and compliant with the regulations. Non-compliance with telemarketing regulations may lead to penalties and other legal consequences.
